Terms of Service

Simple Marketing, a product of Simple Intelligence Group · Effective June 11, 2026

Agreement

These terms govern your use of Simple Marketing, a marketing automation platform operated by Simple Intelligence Group ("SIG," "we," "us"). By creating a workspace or using the service you agree to these terms on behalf of yourself and, where applicable, your organization.

Your account and workspace

You are responsible for the accuracy of your account information, the security of your sign-in credentials, and the activity that occurs in your workspace. Workspace administrators control membership and roles for their workspace.

Acceptable use

You may use the service only to send communications you are legally permitted to send. You must have a lawful basis for contacting every subscriber on your lists, honor unsubscribe requests, and comply with applicable law including CAN-SPAM, CASL, and GDPR. You may not use the service to send spam, malware, deceptive content, or content that infringes the rights of others. We may suspend sending that threatens platform deliverability or violates these terms.

Your content

You retain ownership of the content and subscriber data you bring to the service. You grant us the limited rights needed to operate the service on your behalf (storing, processing, and transmitting your content). Our handling of personal data is described in our Privacy Policy.

AI-assisted features

The service includes AI-assisted drafting. AI output is provided as a starting point; you are responsible for reviewing content before sending it. AI-generated records are labeled in the product.

Billing

Paid plans are billed through Stripe on the schedule shown at checkout. Fees are non-refundable except where required by law. You may cancel at any time; cancellation stops future renewals.

SMS messaging

Where SMS is enabled, Simple Marketing sends text messages through Azure Communication Services from a United States 10-digit long code registered to Simple Intelligence Group. This section governs those messages. SMS is available in the United States only.

What we send. Service and account notifications to workspace administrators (for example sign-in alerts, send failures, approval requests, and billing notices), and marketing messages to recipients whose consent the sending workspace has recorded.

How you opt in. You receive messages only after you give consent, by submitting a form that says so, by texting a keyword we publish, or by agreeing in writing at the point we collect your number. Consent to receive marketing messages is never a condition of buying anything. Workspaces sending through the platform are responsible for obtaining and evidencing consent from their own recipients before adding them.

Message frequency varies. Frequency depends on the notifications you enable and the campaigns you have opted into.

Message and data rates may apply. Your mobile carrier charges these, not us.

Opt out and get help. Reply STOP to any message to stop receiving them. Reply HELP for assistance, or email support@simpleintelligencegroup.com. An opt-out takes effect on the number that sent it and is honored without further action from you.

Carriers. Mobile carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier, your device, and network conditions, none of which we control.

How we handle the phone numbers and consent records behind these messages is described in our Privacy Policy. We do not sell or share mobile numbers or SMS consent with third parties for their own marketing.

Availability and support

We aim for high availability but the service is provided "as is" without warranty of uninterrupted operation. Planned maintenance is announced to workspace administrators.

Limitation of liability

To the maximum extent permitted by law, SIG's aggregate liability arising out of the service is limited to the amounts you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Termination

You may stop using the service at any time. We may suspend or terminate workspaces that violate these terms, with notice where practicable. Data handling after closure is described in the Privacy Policy.

Changes

We may update these terms; material changes will be announced to workspace administrators by email before they take effect.
